PC 288.5 Defined

An adult who resides with a minor under 18 that commits more than three lewd acts or “substantial” sexual contact with a minor and did so within the space of three months is prosecuted as violating CPC 288.5. The sexual contact could be oral sex, masturbation, or sexual intercourse with the child. Sexual acts with a child under 10 is covered by PC 288.7, which has different penalties.

In order to prosecute for CPC 288.5 Continuous Sexual Abuse of a Child, the prosecution has the burden to prove you are guilty of:

  • sexual intercourse, masturbating or engaging in oral sex with a minor
  • doing so with a person that is under the age of 18
  • continuous acts that occurred three times or more, in the space of three months

Felony:

  • 6, 12 or 16 Years in California State Prison
  • Registration as a lifetime sex offender
