PC 463 Defined
California defines looting as stealing or burglarizing during a riot or public state of emergency. It is essentially taking advantage of a dire situation that is beyond the control of authorities.
Penalties for Violating CPC 463
Looting Penalties:
Looting via Petty Theft is a misdemeanor punishable by:
- Imprisonment in the county jail between 90 days and 6 months
Looting via Grand Theft or Burglary can be a misdemeanor or felony, and those found guilty can face:
- Misdemeanor: 180 days to one year in jail
- Felony: up to 3 Years in the California State Prison
Looting via Grand Theft with a Firearm is a felony punishable by:
- 180 days to 3 Years in the California State Prison
Added Notes on California Looting:
It’s important to note that the above penalties carry very similar fines to the crimes under which looting is conducted (petty theft, grand theft, burglary or theft with a firearm). It’s noteworthy too that looting mandates minimum sentencing, whereas these other crimes don’t.
Legal Defenses for California Looting
Were you an innocent onlooker during a looting? It isn’t uncommon to get falsely accused by arresting officers in a situation of panic. Many looting cases occur during instances of hurricanes, earthquakes, fires, floods, or even before a looming crisis where a curfew had been declared. Looting can unfold from the minute a state of emergency is announced, to when this declaration has been lifted.
