According to California Penal Code 476A, Writing Bad Checks is defined as intentionally writing a bad check to pay for goods or services.
In order to prosecute for CPC 476A Orange County Writing Bad Checks, the state has the burden to prove you were guilty of either:
- You wrote an invalid check
- You were aware that the check was invalid
- You planned this fraud
Penalties for CPC 476A Violations
Writing Bad Checks can be filed as a felony or misdemeanor penal code offense, and those found guilty can face:
- Misdemeanor – Up to I Year in the Orange County Jail and a potential $1,000 maximum fine
- Felony – 3 Years in the California State Prison and a potential $10,000 maximum fine
Bad checks drafted for $450 or less, are automatically filed as a misdemeanor if the offender has no related theft charges, or prior convictions for CPC 476 A.
