What Is Considered Tax Evasion in California?
Tax evasion is a serious crime that can result in severe penalties, including imprisonment and large fines. In order to be convicted of tax evasion, the prosecution must prove that the defendant willfully attempted to evade paying their taxes. The two major types of tax evasion are:
Direct Tax Evasion
Direct tax evasion occurs when a person tries to illegally avoid paying taxes that are due to the state of California. This includes situations where a person intentionally fails to report taxable income or falsely claims deductions to reduce their tax liability. Below are some examples of direct tax evasion:
- Willfully failing to file a tax return
- Willfully failing to pay taxes owed
- Filing a fraudulent tax return
- Willfully making false statements on a tax return
Tax evasion can also be charged as a felony or a misdemeanor. If a person is convicted of felony tax evasion, they may face serious penalties, including fines and incarceration. If a person is convicted of misdemeanor tax evasion, they may face fines and/or time in jail.
Indirect Tax Evasion
Indirect tax evasion occurs when a person attempts to illegally avoid paying taxes that are owed to other parties. This includes situations where a person attempts to illegally avoid paying their sales tax to the state of California. Below are some examples of indirect tax evasion:
- Willfully failing to collect or pay sales tax owed
- Willfully failing to remit sales tax collected
- Willfully failing to report taxable sales
- Willfully failing to report sales tax collected
Indirect tax evasion can also be charged as a felony or misdemeanor. If convicted of misdemeanor indirect tax evasion, a person may also face fines and/or jail time.
